Terms of Use

These terms are an agreement between you and Kidful. Kidful is operated by an individual based in Ontario, Canada (“Kidful”, “we”, “us”). The terms apply whenever you use kidful.ca, whether you host a gathering or reply to an invitation. By creating an account or using Kidful, you agree to them. Please also read our Privacy Policy, which explains how we handle personal information.

The short version

1. Who can use Kidful

You must be an adult (the age of majority where you live) to create an account or reply to an invitation. Children may be named in invitations by their parents or guardians, but they may not use Kidful themselves.

2. Your account

Give accurate information and keep your password private. You are responsible for what happens under your account. If you think someone else has accessed it, contact us right away at hello@kidful.ca.

Your invitation link is personal to your household, so please don’t share it. The host will see your reply, pick-up details and any private note you add. Share only the information you are comfortable with the host knowing. If you have a concern about how a host is using your information, you can contact them or us.

You keep ownership of what you add to Kidful, such as gathering details, messages and files. You give us a limited permission to store, copy, display and send that content, only as needed to run Kidful for you and your guests. That permission ends when the content is deleted, except for copies kept for a short time in backups. You confirm that you have the right to add the content you share. We may remove content that breaks these terms.

7. Waivers and venues

Kidful can help hosts share waiver forms and track whether guests have completed them. Kidful is not a party to any waiver, does not give legal advice, and does not check whether a waiver is valid, complete or enforceable. The host and the venue are responsible for their waivers. If you are sent to a venue’s own website, that venue’s terms and privacy policy apply there.

8. Other services

Kidful relies on other services to work, such as email and text message delivery, maps, Google sign-in and browser notifications. We are not responsible for how those services work. We cannot guarantee that every email, text or notification will be delivered or arrive on time.

9. Changes to Kidful

Kidful is currently free. We may change, pause or stop parts of Kidful. If we ever introduce paid features, we will explain the price before you pay anything. If we plan to shut Kidful down, we will try to give hosts reasonable notice so they can save what they need.

Kidful’s name, design, artwork, invitation templates and software belong to us. You may use them only through Kidful, as these terms allow.

11. Disclaimers

We work hard to keep Kidful reliable, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, error-free or fit for a particular purpose. Kidful is a planning tool. Hosts and guests are responsible for the gatherings themselves, including supervision, safety, food and allergies.

12. Limitation of liability

To the extent the law allows, Kidful is not liable for indirect, incidental, special or consequential damages, or for lost data, lost profits or missed events. Our total liability for any claim relating to Kidful is limited to the greater of CAD $100 or the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for gross negligence or intentional misconduct.

13. Responsibility for misuse

If you break these terms or misuse Kidful, and that leads to a claim against us, you agree to cover our reasonable costs of that claim, to the extent the law allows.

14. Ending your use

You can stop using Kidful at any time and ask us to delete your account. We may suspend or close an account that breaks these terms or puts others at risk. Where it is reasonable, we will tell you first.

15. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes will be heard in the courts of Ontario. If you are a consumer living in another province, including Quebec, you keep any rights and protections your local consumer protection laws give you.

16. Changes to these terms

We may update these terms. We will change the date at the top. If a change is significant, we will tell hosts by email or in the app before it takes effect. If you keep using Kidful after a change takes effect, that means you accept the updated terms.
